Do you know what a DPO does?

Data Protection Officer (DPO) = Officer: The General Data Protection Law (LGPD) establishes the role of this professional: Art. 5, VIII – officer: a person appointed by the controller and operator to act as a communication link between the controller, data subjects and the National Data Protection Authority (ANPD). Art. 41 of the same law determines that every controller must appoint an officer for the processing of personal data. In compliance with Law No. 13.708/2019, in effect since September 18, 2020, companies and public bodies must adapt, reviewing their internal policies for the processing of personal data. Before the LGPD, the use of personal data lacked specific regulation, a scenario that the new law came to transform.

The Responsibilities of the DPO

  • Implement and manage the data protection compliance program in accordance with legislation.
  • Prepare and conduct Data Protection Impact Reports (DPIA) when required by the ANPD.

  • Be the direct point of contact for data subjects and the National Data Protection Authority (ANPD).
  • Develop and deliver training and awareness actions on the LGPD for employees.
  • Facilitate and ensure compliance with privacy legislation across all company departments.
  • Create and manage the company's internal data protection committee.

GENERAL DATA PROTECTION REGULATION (GDPR): This is the European Union's General Data Protection Regulation, which served as a fundamental reference for the creation of the General Data Protection Law in Brazil.
